MailBNB Acceptable Use Policy (AUP)

Effective Date: 01.01.2025

This Acceptable Use Policy (“AUP”) governs the use of the email delivery and automation services (the “Services”) provided by MailBNB Ltd. (“MailBNB”, “we”, “our” or “us”).

By using the Services, you (“Customer”) agree to comply with this AUP. This policy is incorporated by reference into the MailBNB Terms of Service.

MailBNB may update or modify this AUP from time to time. Updated versions will take effect upon posting on the MailBNB website.

1. Lawful and Responsible Use

1.1 Lawful Purpose.

You may use the Services only for lawful purposes and in accordance with this AUP and all applicable laws and regulations, including data protection, privacy, and anti-spam laws (such as the CAN-SPAM Act, GDPR, and the ePrivacy Directive).

1.2 Permission-Based Sending.

You may send marketing or promotional messages only to recipients who have given explicit, verifiable consent (“opt-in”). The use of purchased, rented, scraped, or third-party lists is strictly prohibited.

1.3 Proof of Consent.

Upon request, you must promptly provide evidence of consent for any contact, including the date, source, and method by which consent was obtained.

1.4 Unsubscribe Mechanism.

All marketing and promotional messages must contain a clear and functional unsubscribe or opt-out mechanism. Unsubscribe requests must be honored within a commercially reasonable timeframe and as required by law.

1.5 Accurate Identification.

The “From,” “To,” and “Reply-To” fields, as well as routing information, must accurately reflect the sender’s identity and domain. Falsifying or misrepresenting sender identity is prohibited.

1.6 Privacy and Security.

You must maintain a privacy policy that complies with applicable data protection laws and implement appropriate security measures to safeguard user data.

2. Prohibited Conduct

You may not use, encourage, or allow others to use the Services to:

(a) Send unsolicited bulk or commercial messages (“spam”);
(b) Send messages that violate anti-spam, privacy, or consumer protection laws;
(c) Disseminate fraudulent, deceptive, or misleading content;
(d) Harass, threaten, defame, or abuse any individual or organization;
(e) Transmit viruses, malware, or any form of malicious code;
(f) Engage in phishing, spoofing, or impersonation;
(g) Infringe or misappropriate the intellectual property rights of others;
(h) Engage in activities that may harm MailBNB’s systems, networks, or reputation;
(i) Validate, verify, or harvest email addresses without consent; or
(j) Use the Services for any activity listed in the Prohibited or Restricted Industries appendix below.

3. Sending Practices and Deliverability Standards

3.1 Reputation Management.

You must maintain acceptable complaint, bounce, and unsubscribe rates consistent with industry best practices. MailBNB may impose thresholds and take corrective measures, including rate limitation or suspension, to protect network reputation.

3.2 Content Standards.

You are solely responsible for all content transmitted via the Services. Content must comply with applicable law, must not contain deceptive subject lines or header information, and must not promote prohibited products or services.

3.3 Infrastructure Integrity.

You may not take any action that interferes with MailBNB’s network operations or that could cause IP, domain, or reputation blacklisting.

4. Enforcement

4.1 Monitoring and Investigation.

MailBNB may monitor network usage and content as necessary to ensure compliance. MailBNB reserves the right to investigate suspected violations of this AUP.

4.2 Suspension or Termination.

MailBNB may suspend or terminate Services immediately if it determines that your activity violates this AUP or threatens MailBNB’s infrastructure, customers, or reputation.

4.3 Reporting Abuse.

Suspected AUP violations should be reported to abuse@mailbnb.com. MailBNB investigates all credible complaints.

4.4 Legal Cooperation.

MailBNB may cooperate with law enforcement, regulators, or affected third parties in investigating any alleged misconduct.

5. Updates

MailBNB may modify this AUP at any time. Continued use of the Services after such updates constitutes acceptance of the revised policy.

Appendix A: Prohibited or Restricted Industries

MailBNB’s Services may not be used to send, promote, or facilitate content associated with any of the following industries or activities.

MailBNB reserves the right to update or expand this list at its sole discretion.

1. Illegal or High-Risk Activities

2. Controlled or Restricted Substances

3. Financial, Crypto, and Investment Products

4. Weapons and Dangerous Materials

5. Unethical or Harmful Marketing Practices

6. Sensitive or Regulated Content

7. Other Restricted Activities

MailBNB may prohibit or require pre-approval for any use case that, in its reasonable judgment:
